APPEAL COURT OVERTURNS ORDER: ABURE AND CO. FREE TO OPERATE

In a groundbreaking development, the Court of Appeal in Abuja has overturned the judgment of the Federal Capital Territory High Court, allowing Julius Abure and two others to resume their roles as national officers of the party. The ruling, a result of an ex parte application on April 5, 2023, marks a significant shift in the legal landscape surrounding their positions.

Background of Restraining Order:

Presiding Judge Hamza Muazu, in the April 5, 2023 ruling, had restrained Abure, along with Farouk Ibrahim, Clement Ojukwu, and Oluchi Opara from functioning as national officers of the LP. This decision also included the dismissal of Abure’s objection challenging his removal as the LP chairman. The case, initiated by a group led by Martins Esikpali John, accused the defendants of forging FCT high court documents for illicit substitutions in recent elections.

 Appeal and Legal Reversal:

Seeking justice, the defendants took the matter to the appeal court. In a lead judgment delivered on Wednesday, Justice Hamman Barka declared that the high court had erred in assuming jurisdiction over the case. The decision effectively nullifies the previous restrictions, allowing Abure and his co-defendants to operate freely as national officers of the party.

Compensation Awarded:

In a notable move, Justice Barka awarded N1m in favor of the appellants, signaling a financial redress for the legal challenges they faced. This decision adds a layer of significance to the appeal court’s judgment, emphasizing the court’s stance on the incorrect assumption of jurisdiction.
