INTERPOL Arrests James Nolan in Italy

Introduction 

The International Criminal Police Organisation (INTERPOL) has apprehended James Nolan, a director of Process and Industrial Development Limited (P&ID), in Italy. Nolan, an Irish national with British citizenship, is a key figure in the $9.6 billion P&ID scandal that unfolded in Nigeria. The arrest occurred on January 27, 2024, while Nolan was visiting his wife.

Background on P&ID Scandal

Nolan was implicated in the controversial Gas Supply Processing Agreement signed in 2010. The scandal led to a $9.6 billion judgment debt against Nigeria. Despite facing charges and being granted bail in 2019, Nolan jumped bail in 2022, prompting a bench warrant for his arrest.

Legal Developments

Nolan’s counsel, Paul Erokoro, confirmed awareness of the arrest, emphasizing the need for official confirmation from the Economic and Financial Crimes Commission (EFCC). The EFCC plans to seek Nolan’s extradition for trial in Nigeria.

Court Proceedings

Nolan, who faces multiple charges in various courts, failed to appear for trial since 2022. In 2023, a judge revoked his bail and issued a bench warrant, allowing security agencies, including INTERPOL, to arrest him. His surety forfeited a N100 million bail bond, and the case proceeded with Nolan absent.

International Repercussions

A London court presided over by Justice Robin Knowles quashed the $11 billion awarded against Nigeria in October 2023, citing fraud and a violation of public policy in the P&ID Ltd. case.

Ongoing Legal Proceedings

As Nolan’s trial continues in multiple Nigerian courts, the adoption of final written addresses was scheduled for February 15, 2024, before Justice Donatus Okorowo. However, the proceedings were halted due to the judge’s official engagement.
